Un defecto de forma en el recurso planteado por la Diputación de Guipúzcoa y las Juntas Generales, obliga a paralizar definitivamente el cobro de los peajes que durante los 3 últimos años se vienen exigiendo a los transportistas
Después de tres años exigiendo a los transportistas que diariamente transitan por la N-1 y la A-15 un peaje calificado por el sector y por el alto tribunal como “discriminatorio” , finalmente el Tribunal Supremo ha puesto punto y final al proceso judicial que se ha alargado más de la cuenta debido a los recursos presentados por la Diputación de Guipúzcoa y las Juntas Generales.
Ahora, el Tribunal Supremo, en un Auto de fecha 6 de mayo, y que ha sido notificado este jueves a las partes recurrentes, ha resuelto inadmitir los recursos de casación interpuestos en su día por la Diputación Foral de Guipúzcoa y las Juntas Generales contra la sentencia del TSJ del País Vasco que declaró ilegal por dos veces la norma que establece el cobro de un peaje a los más de 10.000 camiones que diariamente transitan por la N-1 y la A-15, y que han seguido aplicando bajo la excusa de que dicha decisión no era firme hasta el pronunciamiento del Alto Tribunal.
Así, en el peor de los escenarios que podían esperar ambas instituciones guipuzcoanas, el Supremo inadmite la posibilidad de casación al existir un defecto de forma en la presentación del recurso, que según se señala en el Auto “carece de los requisitos mínimos exigibles para que proceda su admisión”, con el agravante además de que no cabe recurso alguno contra dicha decisión. lo que supone en la práctica la eliminación y supresión definitiva de los peajes en dicho territorio.
Esta decisión del Supremo obligará a la Diputación de Guipúzcoa a la paralización inmediata del cobro de los peajes, abriéndose asimismo la puerta a que los transportistas puedan recuperar todo el importe “indebidamente” recaudado durante sus 3 años y medio de vigencia.
