Cada vez más sentencias judiciales estrechan el cerco a las relaciones contractuales que mantienen las plataformas de comercio electrónico con sus repartidores y conductores.
La semana pasada, ha sido la Corte Suprema del Reino Unido la que ha sentenciado que existe una relación laboral entre Uber y sus conductores, al tiempo que deniega que la plataforma se limite a ser un mero proveedor tecnológico.
Sin embargo, el máximo órgano jurisdiccional británico esgrime cinco motivos para defender que la relación de Uber con sus conductores se adapta a una relación laboral tradicional.
En primer lugar, estima que es la plataforma la que determina lo que debe cobrar cada conductor por sus servicios, mientras que, en segundo, Uber es la que impone los contratos, sin que sus ‘riders’ puedan modificarlos a voluntad.
En tercer lugar, la Corte Suprema estima que los conductores no pueden decidir sobre los servicios que aceptan o rechazan. Así mismo, el Tribunal también argumenta que la plataforma también controla la manera en que los conductores prestan su labor y, finalmente, se afirma que Uber restringe al máximo las comunicaciones entre los clientes y sus conductores para controlar al máximo la actividad.
Consecuentemente, la Corte Suprema estima que existe una relación de dependencia y subordinaciónen las relaciones que establece la plataforma con sus subordinados por lo que los considera trabajadores no solo mientras realizan los desplazamientos, sino desde el mismo momento en que empiezan a utilizar la aplicación móvil de la compañía.
En este marco, los sindicatos europeos aumentan la presión para que la Unión Europea considere que las plataformas tecnológicas mantienen relaciones laborales con sus conductores, de cara a la regulación que está elaborando.
